1. Accommodation Provider and scope of these Terms

  1. The accommodation provider and operator of the Samaya Apartments brand is David Kaufman, with registered address at Nepomuckých 749/17, 199 00 Prague 9, Company ID: 01390759, email: info@samayaapartments.cz, telephone: +420 774 750 878 (the “Accommodation Provider”).
  2. These Terms & Conditions govern the provision of short-term accommodation in the accommodation unit specifically identified in the booking confirmation.
  3. A person who enters into an accommodation contract or uses the accommodation is referred to in these Terms as the “Guest”.

2. Conclusion of the contract and booking

  1. The accommodation contract is concluded when the booking is confirmed by the Accommodation Provider or the relevant booking platform and the payment conditions stated in the booking confirmation are fulfilled.
  2. The specific details in the booking confirmation, in particular the accommodation unit, dates of stay, price, number of guests, payment terms and cancellation conditions, take precedence over the general provisions of these Terms.
  3. Bookings made through Booking.com, Airbnb or another booking platform are also subject to the relevant platform's terms. In the event of a conflict concerning payment or cancellation, the condition confirmed for the specific booking through the platform takes precedence.
  4. The Guest must check the details in the booking confirmation and report any discrepancy without undue delay.
  5. For accommodation booked for specific dates, a consumer does not have the statutory right to withdraw from the contract within 14 days without giving a reason. The agreed cancellation conditions remain unaffected.

3. Price and payment terms

  1. The accommodation price is stated in the booking system, booking confirmation or offer made by the Accommodation Provider.
  2. For a direct booking made through the Samaya Apartments website, the full price of the stay (100%) is payable immediately when the booking is completed through the available payment gateway. The booking is bindingly confirmed only after the payment has been successfully received, unless the Accommodation Provider and the Guest expressly agree otherwise in writing.
  3. For a booking made through Booking.com, Airbnb or another booking platform, the due date and payment method are governed by the conditions confirmed by that platform for the specific booking.
  4. As a standard rule, the Accommodation Provider does not require or collect a security deposit for direct bookings.
  5. However, in a justified exceptional case, the Accommodation Provider reserves the right to require a refundable security deposit before the stay begins, in particular where the specific circumstances of the stay create an increased risk of damage. The Accommodation Provider will notify the Guest in writing, within a reasonable period before the stay begins, of the amount, payment method, purpose and refund conditions. The security deposit must be proportionate to the circumstances and must not be imposed arbitrarily.
  6. The security deposit may be used only to secure a documented claim for damage, missing equipment, extraordinary cleaning or other reasonably incurred costs resulting from the Guest's breach of obligations. Normal wear and tear is not considered damage. If no such claim arises, the Accommodation Provider will return the security deposit without undue delay, normally within 7 days after departure; the actual time required for the funds to be credited may depend on the payment method used.
  7. The Accommodation Provider may change the standard rules concerning security deposits for future bookings by publishing a new version of these Terms. Any such change will apply only to bookings made after the new version becomes effective and will not affect an already confirmed booking unless the change is more favourable to the Guest or the parties agree otherwise.

4. Guest registration and self-service access

  1. All accommodated persons must be included in the booking and duly registered to the extent required by applicable law.
  2. Registration may be completed through Chekin or by another method specified by the Accommodation Provider.
  3. Providing the information required by law, completing registration and fulfilling the payment conditions are prerequisites for starting the stay and receiving access details.
  4. An access code, key or other access credentials are intended solely for registered Guests. The Guest must not share them with third parties or allow unregistered persons to enter without the Accommodation Provider's prior consent.
  5. The Guest is responsible for misuse of access credentials caused by sharing them or failing to protect them adequately.

5. Rules of stay

The Guest must:

  1. comply with these Terms, the published House Rules, and the Accommodation Provider's safety and operating instructions;
  2. use the apartment and its equipment properly and solely for the purpose of short-term accommodation;
  3. observe the standard check-in time from 15:00 to 23:00 and check out no later than 10:00, unless another time has been confirmed in advance;
  4. observe the apartment's maximum capacity of 4 persons;
  5. respect quiet hours from 22:00 to 7:00, the neighbours and the building's common areas;
  6. not organise parties, loud celebrations or other events;
  7. not smoke in the apartment or the building's common areas, including electronic cigarettes;
  8. not bring pets into the apartment;
  9. not, without the Accommodation Provider's consent, interfere with thermostats, water fittings, electrical installations, locks, the modem, appliances or other technical equipment in any way inconsistent with normal use or the instructions provided;
  10. report any defect, emergency, damage or safety risk without undue delay;
  11. lock the apartment on departure and return keys or other access devices as specified in the instructions.

To the extent permitted by applicable law, the Guest is also responsible for the conduct of persons whom the Guest allows to enter the apartment.


6. Rights and obligations of the Accommodation Provider

  1. The Accommodation Provider will provide the apartment in a condition suitable for proper use and will provide the agreed services.
  2. The Accommodation Provider may refuse to commence the stay if mandatory registration has not been completed, the agreed price has not been paid, or the number of persons does not correspond to the booking.
  3. In the event of a serious or repeated breach of these Terms, disturbance of neighbours, risk to safety or damage to property, the Accommodation Provider may require the Guest to remedy the situation. If the Guest fails to do so, or the situation requires immediate intervention, the Accommodation Provider may terminate the stay early in accordance with applicable law.
  4. The Accommodation Provider may enter the apartment in the event of an emergency, an immediate risk to persons or property, reasonable suspicion of a serious breach of the rules, or a necessary service intervention. Where the circumstances allow, the Guest will be informed in advance.
  5. Early termination of the stay does not affect the Accommodation Provider's justified claims for payment of the price, damage or extraordinary costs. Any rights of the Guest that cannot be excluded by law remain unaffected.

7. Cancellation policy

Unless the booking confirmation states otherwise, the following conditions apply to direct bookings:

  1. cancellation no later than 24 hours before the standard start of the stay at 15:00, i.e. no later than 15:00 on the day before the scheduled arrival: no cancellation fee and a full refund of the amount paid;
  2. cancellation after that deadline or failure to arrive: a cancellation fee of 100% of the price of the stay, and the amount paid is therefore non-refundable;
  3. where a different cancellation condition, including a non-refundable rate, was expressly stated for the specific booking before it was confirmed, that individually confirmed condition takes precedence.

Any amount refundable under the cancellation conditions will be sent without undue delay, normally within 3 working days. The time required for the amount to be credited depends on the payment method used.

Bookings made through Booking.com, Airbnb or another booking platform are subject to the cancellation conditions confirmed by that platform for the specific booking.


8. Damage and extraordinary costs

  1. The Guest is responsible for damage caused by the Guest or by persons whom the Guest allows to enter the apartment.
  2. The Guest must report any damage without undue delay.
  3. The Accommodation Provider may claim compensation for demonstrable damage and reasonably incurred costs of repair, service intervention, replacement arrangements, missing equipment or extraordinary cleaning.
  4. If a security deposit was exceptionally required in accordance with Article 3, the Accommodation Provider may set off a documented claim that is due against the security deposit to the extent permitted by law. In other cases, the Accommodation Provider may require separate payment of the claim.
  5. Normal wear and tear resulting from proper use of the apartment will not be charged to the Guest.

9. Technical failures and extraordinary events

The Accommodation Provider is not liable for an interruption or restriction of services caused by circumstances beyond its reasonable control, such as a failure of public electricity, water or internet supplies, an intervention by a public authority or an extraordinary event, provided that the Accommodation Provider did not cause the breach and took reasonable steps to remedy the situation.

This does not affect the Guest's statutory rights where the accommodation or agreed services could not be properly provided.


10. Complaints

  1. The Guest should report any defect or deficiency without undue delay so that the Accommodation Provider has an opportunity to remedy it during the stay.
  2. A complaint may be submitted by email to info@samayaapartments.cz. The Guest is advised to include the booking identification, a description of the issue and any supporting evidence available.
  3. A later notification does not in itself deprive the Guest of statutory rights, but it may make it more difficult to prove the defect or remedy it during the stay.
  4. A consumer complaint will be accepted and handled without undue delay and no later than within the period prescribed by applicable law; unless a longer period is agreed, this period is 30 days.

11. Virtual AI assistant

  1. Samaya Apartments may voluntarily make a virtual assistant using artificial intelligence available to Guests. At the start of the interaction, the Guest will be appropriately informed that they are communicating with an AI system.
  2. The assistant is intended only to provide general information about the stay, apartment, arrival, departure, amenities, House Rules and local recommendations.
  3. The assistant's responses are for information only and may contain inaccuracies. In the event of a conflict, the booking confirmation, these Terms, the House Rules and an explicit written statement from an authorised member of the Samaya Apartments team take precedence.
  4. The assistant is not authorised to confirm or change bookings, prices, payments, cancellations, refunds, compensation, exceptions to rules or any other contractually or financially significant matter.
  5. Any such action is effective only after explicit confirmation by an authorised member of the Samaya Apartments team by email, telephone or through the booking platform.
  6. The assistant is not intended for emergencies. In the event of a threat to life, health or property, the appropriate emergency service must be contacted first, followed by the Accommodation Provider.
  7. The Guest should not send payment details, identity documents, access PINs or other sensitive information through the assistant.

12. Personal data protection

Information about the processing of personal data in connection with bookings, registration, the provision of accommodation and the use of communication channels or the virtual assistant is set out in the separate
Samaya Apartments Privacy Policy.


13. Out-of-court resolution of consumer disputes

If a consumer dispute cannot be resolved directly with the Accommodation Provider, the consumer may submit a proposal for out-of-court dispute resolution to the competent body:

14. Final provisions

  1. The legal relationship is governed by the laws of the Czech Republic, in particular the provisions governing accommodation contracts.
  2. The version of these Terms effective at the time a specific booking is made applies to that booking. A later amendment will not affect an already confirmed booking unless the amendment is more favourable to the Guest or has been agreed.
  3. If any provision is invalid or ineffective, this will not affect the validity of the remaining provisions.
  4. These Terms do not restrict any mandatory consumer rights or any liability that cannot be excluded by law.
  5. The current version of these Terms is published on the Samaya Apartments website.
